Windhoek, Namibia Legal experts and political analysts from South Africa have raised concerns over Namibian President Nangolo Mbumba’s decision to extend the country’s election timeline, questioning its constitutional validity and potential implications for democracy.
The controversy arose after the Namibian government announced a possible extension of the upcoming general elections, citing logistical challenges and administrative constraints. While officials argue that the move aims to ensure a fair and transparent electoral process, critics warn that such an extension could undermine democratic principles and set a worrying precedent for future elections.
South African legal scholars, particularly constitutional advocates, have expressed skepticism about whether the Namibian constitution grants the president unilateral authority to alter the election schedule. Some argue that any changes to the electoral timeline should be subjected to parliamentary approval and judicial review to prevent potential political manipulation.
Prominent South African advocate and constitutional law expert, Professor Thabo Maseko, stated that while election extensions are sometimes necessary in cases of national emergencies or crises, they must be handled with strict legal oversight. Any deviation from the established electoral timeline must be based on clear constitutional provisions. Otherwise, it opens the door for undue political influence over the democratic process, Maseko said.
Namibia’s opposition parties have also expressed concerns, accusing the ruling government of using administrative challenges as an excuse to prolong its stay in power. The Popular Democratic Movement (PDM) and other opposition groups have called for a transparent legal review of the decision, warning that it could erode public trust in the electoral system.
However, Namibian government officials have defended the proposal, insisting that logistical challenges, including delays in voter registration and ballot printing, necessitate the extension. Electoral Commission of Namibia (ECN) chairperson, Advocate Elsie Nghikembua, reassured citizens that the decision was purely administrative and aimed at ensuring a credible election.
The debate has sparked broader discussions on electoral integrity in Southern Africa, with regional observers monitoring the developments closely. The Southern African Development Community (SADC) and legal experts from across the continent may weigh in on the matter as Namibia moves closer to its election date.
